General Terms and Conditions (GTC)
Iron Alps AG
1. Scope
These General Terms and Conditions (GTC) govern the contractual relationship between Iron Alps AG (hereinafter referred to as "Iron Alps") and its customers (hereinafter referred to as "Contractual Partner") with regard to all services offered, in particular:
- Memberships
- Training cards
- Drop-in offers
- Personal and Corporate Training
- Open Gym
- Additional services and events
By concluding a membership, purchasing a training card, booking any other service, entering the premises of Iron Alps or using the website or other online offers, the contracting party agrees to these terms and conditions.
2. Conclusion of the contract
In addition to these General Terms and Conditions, contracting parties may conclude a supplementary agreement for services with Iron Alps. This supplementary agreement is concluded through:
- the online conclusion of a membership or booking via the booking and management system Wodify,
- the purchase of a training card,
- a drop-in on site, or
- Use of an online service provided by Iron Alps.
Once payment has been successfully received, the agreed services can be used to the extent booked. The services are subject to a validity period; after this period, any unused services expire without refund.
3. Contract amendments
Iron Alps reserves the right to unilaterally amend these Terms and Conditions at any time. The amended terms will be communicated to customers in a reasonable manner, preferably by email or by publication on the website, indicating the effective date. If the customer enters into a contract or uses Iron Alps' services after notification of the new Terms and Conditions, the new Terms and Conditions will be deemed accepted from that point forward.
Unless the customer objects to the changes in writing within 30 days of notification, the changes will be deemed accepted. If the customer objects to the changes, Iron Alps reserves the right to terminate the contractual relationship with immediate effect as of the date the new terms and conditions come into force.
4. Iron Alps' achievements
4.1 Classroom Training
A membership or training pass entitles the holder to participate in class training sessions to the agreed extent. Special courses, workshops, or events may be subject to separate fees.
4.2 Open Box
No guided or supervised training takes place in the Open Box. Use is at your own risk.
4.3 Personal Training
Personal training appointments are arranged individually and are binding.
5. Booking and participation
- All training courses require prior booking via Wodify.
- The number of participants is limited.
- Bookings are binding.
- Iron Alps reserves the right to cancel courses with very low numbers of participants at short notice.
6. Closures necessary for business operations, force majeure
Iron Alps reserves the right to close its premises for up to 14 days per calendar year for maintenance, holidays, or internal training without any entitlement to a refund. In the event of longer, unforeseen closures (force majeure), no refund will be issued; however, Iron Alps will, where possible and at its sole discretion, offer alternative services or credit notes.
7. Payment terms and payment processing
7.1 Payment processing
All payments are processed exclusively via the Wodify administration and booking platform.
Iron Alps accepts no liability for the temporary unavailability of the Wodify booking system. Technical malfunctions do not entitle customers to cancellation or claims for damages.
7.2 External Payment Service Providers
Wodify uses external payment service providers (e.g. credit card providers, TWINT, Apple Pay or similar payment methods).
These payment service providers may charge transaction or processing fees.
7.3 Transaction fees
Such fees:
- are determined by the payment service provider
- lie outside the sphere of influence of Iron Alps,
- and will be charged to the contractual partner in addition to the stated price.
Iron Alps accepts no liability for the type, amount, or changes to these fees. The terms and conditions of the respective payment service provider also apply.
8. Cancellation and No-Show
8.1 Classroom Training
- Cancellations are possible up to 2 hours before the course starts.
- Bookings not cancelled within the specified timeframe are considered consumed and will be charged or invoiced to the contracting parties.
In case of repeated no-shows, Iron Alps reserves the right to take organizational measures (e.g., temporary booking restrictions or charging a service fee of CHF 5.00).
8.2 Personal Training
Personal training appointments can be cancelled free of charge up to 24 hours before the start time. For cancellations made later, the full session fee will be charged.
9. Memberships
- Unlimited memberships entitle the holder to use the services offered.
- Limited memberships include a fixed weekly allowance.
- Unused units expire at the end of the respective week.
Memberships are personal and non-transferable unless expressly agreed otherwise.
10. Training cards and drop-ins
- Training passes and drop-ins are personal and cannot be transferred to anyone else.
- The validity period is binding.
- Unused units expire after the deadline.
11. Pause and extraordinary termination
In the event of prolonged inability to train due to illness, pregnancy, or similar reasons, a membership or training pass may be paused or extended at the sole discretion of Iron Alps upon application by the member and presentation of proof. Refunds are excluded in such cases. Subsequent pausing or refunds for non-use, even in cases of illness, are excluded under all circumstances. If the member uses the services during the period of inability to train, the pause or extension ends immediately.
Membership is suspended on a monthly basis. Suspension is only possible after notification of one of the aforementioned reasons. Iron Alps reserves the right to terminate a membership prematurely with immediate effect for good cause. Good cause exists in particular if the member:
- violates instructions from the coaches or essential provisions of these terms and conditions or other contracts;
- misuses training equipment or infrastructure or disrupts training operations or impairs other members;
- behaves improperly or disrespectfully towards other members or employees;
- behaves in a potentially criminal manner (e.g., filming other people without their consent, sexual harassment); or
- opens or operates a business during the current membership that is in direct competition with Iron Alps.
A warning is usually issued before termination, unless the severity of the incident justifies immediate dismissal.
In the event of justified early termination, the remaining membership fee will be refunded on a pro-rata basis. Further claims remain reserved.
12. Contract duration, renewal and termination
- The duration of a membership depends on the chosen subscription (e.g. 3, 6 or 12 months).
- Membership ends automatically upon expiry of the agreed term and does not renew automatically unless the member explicitly requests it.
- Membership renewal is done exclusively by the member via their personal Wodify account.
- No cancellation is required during the subscription period, as the subscription ends automatically at the end of the term.
In justified exceptional cases, membership renewal or extension can be processed via a separate invoice. This requires prior consultation and approval from Iron Alps.
13. Upgrade and Downgrade
- Upgrades (additional services, booking a more expensive and comprehensive Iron Alps service package) are possible at any time and will apply from the following month.
- Downgrades (receiving less service, opting for a cheaper and less comprehensive service package from Iron Alps) are only possible at the end of the contract term, subject to compliance with the contractual notice period.
14. Health and personal responsibility, insurance
CrossFit, functional training, and all other programs are physically demanding. The contracting party confirms and is responsible for ensuring they are physically fit to participate in the respective training and to immediately pause the exercises if they experience discomfort or pain.
In case of health limitations, it is the responsibility of the contracting partner to seek medical advice before starting training and to have their ability to train assessed by experts.
It is the responsibility of the contracting party to obtain adequate accident and liability insurance.
15. Disclaimers and limitations of liability
Iron Alps is liable only in cases of intent and gross negligence in combination with injury to life, body or health.
Any further liability is excluded.
Iron Alps is not liable for the loss of valuables, money, clothing, or other assets, even if these are locked away. Use of the infrastructure is entirely at your own risk; Iron Alps disclaims all liability for accidents not caused by direct intentional or grossly negligent conduct, and not resulting in injury to life, body, or health caused by Iron Alps personnel.
It is the responsibility of the contracting party to obtain adequate accident and liability insurance.
The contracting party acknowledges that other tenants, users, or visitors may also be present on the premises and in the areas provided. This applies in particular to areas such as training rooms, sanitary facilities (toilets and showers), changing rooms, and other communal areas that may be shared with other tenants or users.
Iron Alps is not liable for the actions, omissions, or other conduct of other tenants, users, visitors, or other third parties present on the shared or adjacent premises. This applies in particular to damages, impairments, or disturbances caused by other tenants or their companions, unless these are due to intentional or grossly negligent conduct on the part of Iron Alps.
16. Data protection, creation of video and photo recordings
Personal data is processed in accordance with applicable data protection legislation. The full privacy policy can be viewed on the Iron Alps website.
The contracting party agrees that photos and videos may be taken during training in which they may be recognizable. Iron Alps is entitled to use this material for marketing purposes (website, social media). Objection to this may be made at any time, either in writing or verbally, if recordings are being made.
17. House Rules
The instructions of the coaches and the Iron Alps rulebook must be followed. Violations entitle Iron Alps to exclusion from training or immediate termination of all contracts.
18. Final Provisions
Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
Swiss law applies. The exclusive place of jurisdiction for all disputes and disagreements relating to these terms and conditions and all other contracts between Iron Alps and the contractual partner is the registered office of Iron Alps.
